The members of Boomerang – The Club, C’est la vie at Jaypee Greens Wish Town – have issued six formal demands to Jaypee Associates Ltd (JAL) and its Resolution Professional (RP), Bhuvan Madan.
The members allege that the land designated in the approved Master Plan for their private, members-only club has been replaced — without regulatory sanction or member notification — by a commercial complex called the Boomerang Complex.
“Yet again, home buyers in Wish Town are getting short-changed! The Boomerang Complex does not exist in the Master Plan of Jaypee Greens Wish Town. Who authorised building a commercial complex in place of a private, members-only, exclusive club?”, said Ravi Capoor, Secretary, Government of India (Retd), and co-signee of the Joint Representation of Boomerang – The Club Members.
The club, which was designed and sold as a facility whose membership could only be sold to Jaypee Wishtown residents is now being offered to outsiders too. It’s like a developer building a gym to be used by residents of the facility selling access to outsiders too.
Members are demanding that JAL and the RP produce the competent authority’s written sanction for the commercial construction, all planning and zoning approvals, and an explanation of who authorised Jaypee Hotels Ltd — with whom members hold no contract — to collect their annual subscription fees. They also demand audited accounts for all maintenance deposits held on members’ behalf, and a full count of life members with clarity on their contractual entitlements.
“When a company is going through an NCLT-driven insolvency process, no asset transfer can take place other than through the NCLT process — not by the management, not by the promoters. The management also cannot take away the rights of lifetime club members without their explicit consent,” said Subramanian Murali, Boomerang Club Member and Senior Finance Professional.
Members have formally asked the RP to confirm whether he permitted the Jaypee Hotels arrangement and, if so, to produce the relevant order or communication. Pending satisfactory answers, members are withholding further subscription payments without prejudice to their membership rights and reserve the right to approach the NCLT, consumer forums, and regulatory authorities.
“Adani has a chance to do what JAL never did — honour the contractual obligations of Boomerang – The Club, C’est la vie, and treat this community with honesty and respect,” said Captain JJ Nijhawan, Secretary, Wish Town Golf Members Committee.
As the entity now associated with Jaypee Greens Wish Town, Adani Enterprises Ltd is not the subject of the regulatory and financial demands directed at JAL and the RP. Members ask only that Adani publicly commit to honouring the contractual obligations of Boomerang – The Club, C’est lavie — including delivery of the full 50,000 sq ft, three-storeyed, private, members-only facility as represented at the time when memberships were sold.
“JAL is financially bankrupt. What we are exposing today is their moral bankruptcy,” said Maj Gen RPS Bhadauria VSM (Retd), Life Member, Boomerang – The Club.
